Limited Liability Indemnity

This page sets out the limits of our liability and your indemnity obligations when you use cortensteel.co or buy from Corten Steel Company, a division of Caruso Consulting Co Ltd ("we", "us" or "our"). It forms part of our Terms & Conditions.
Your consumer rights come first
Nothing on this page limits or excludes any liability that cannot lawfully be limited or excluded. That includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and your rights under the consumer protection and sale of goods legislation of your province or territory, which cannot be excluded for a consumer purchase. Where those rights apply, they take priority over anything stated here.
Limitation of our liability
Subject to the section above, and to the extent the law allows:
- We are not liable for indirect or consequential loss, or for loss of profit, revenue, data or goodwill.
- We are not liable for loss or damage caused by misuse of a product, by failure to follow the care instructions, or by normal wear and tear.
- Where we are liable, our total liability for any claim connected with an order is limited to the amount you paid for the products in that order.
Where goods are bought for the purposes of a business rather than as a consumer, the implied conditions and warranties in the applicable provincial sale of goods legislation are excluded to the extent that legislation allows.
Website availability
We try to keep the site available and working, but we do not promise uninterrupted or error-free access. We may suspend, withdraw or change all or part of the site without notice.
Your indemnity
You agree to indemnify us against reasonable losses, costs and claims we incur as a result of your breach of our Terms & Conditions, your misuse of the site, or your infringement of another person's rights through your use of the site.
